Colorado Requirements for a Valid Prenuptial Agreement

Colorado prenuptial agreements are governed by the Uniform Premarital and Marital Agreements Act (UPMAA), in effect since July 2014. The UPMAA sets out the conditions an agreement must meet to be enforceable in a Colorado court.

For a prenuptial agreement to be valid under the UPMAA, it must:

Be in writing and signed by both parties
Be entered into voluntarily, free of pressure or duress
Include a reasonably accurate, good-faith description of both parties’ assets, liabilities, and income
Give each party adequate time and access to independent legal counsel before signing

A party may waive the right to independent counsel, but Colorado law requires the agreement to include a Notice of Waiver of Rights: a conspicuous statement in plain language describing the rights or obligations being modified or waived. An agreement lacking proper disclosure or signed under coercion may be challenged or struck down by a court. Notably, conditioning marriage on signing a prenuptial agreement doesn’t by itself constitute duress under Colorado law. Spousal support and attorney fee provisions may also be deemed unenforceable if a court finds them unconscionable at the time of enforcement.

Postnuptial Agreements in Denver

A postnuptial agreement is signed after a couple is already married, outside of any pending divorce proceeding. We handle postnuptial agreements for Denver-area clients across a range of circumstances.
